Night Out on the Town Giveaway (the “Contest”)

Official Contest Rules

The Contest is sponsored by Monarc Hospitality Corp. (the “Sponsor”) with an address at 3200 – 650 West Georgia Street, Vancouver, BC V6B 4P7.

  1. PROMOTION OVERVIEW: The Contest begins at 12:00:01 a.m. Pacific Time (“PT”) on November 1, 2024 and ends at 11:59:59 p.m. PT on December 8th, 2024 (the “Contest Period”). This paragraph is a summary only and the official rules described below govern. There is no purchase required to entry. Odds of winning will depend on the number of eligible entries received before the end of the Contest Period. The prize consists of 2 Club Seat Canucks vs. Boston Bruins Hockey Tickets an approximate value of $1250 and a Keg Steakhouse Gift Card with a value of $250 (collectively the “Prize”). This Contest is only open to those of the legal age of majority in Canada (excluding Quebec).

  2. ELIGIBILITY: MUST NOT BE A MINOR, MUST RESIDE IN CANADA (EXCLUDING QUEBEC) TO ENTER. To be eligible to enter and win the Prize in this Contest, an individual must legally reside within Canada (excluding Quebec) and must have achieved the age of majority in the province or territory in which they reside at the time of entry. Minors may not participate. Age of majority may differ depending on province of residence. It is an entrant’s responsibility to verify the age of majority where they reside.

    An individual is not eligible to enter or win if they are a director, officer or employee of the Sponsor or a member of the immediate family (defined as parents, siblings, children and spouse, regardless of where they live) or household (whether related or not) of any of the above persons.

  3. ENTRY: NO PURCHASE NECESSARY. To enter the Contest entrants must scan the QR code displayed in store or enter via the Sponsor’s website as detailed on social media or printed media. Upon scanning the QR code or visiting the website, the Contest entrants must provide their first and last name, email address, jurisdiction of residence, and age.

    Participation in the Contest is limited to one entry per person.

    Entrants must complete all mandatory details in the entry form for their entry to be valid, and opt to enter the Contest, after which they should receive an on-screen notification confirming their entry into the Contest.

    For the avoidance of doubt, even if a customer is able to complete and submit the form and their entry into the Contest after the Contest Period, and even if a customer receives an on-screen notification confirming their entry, the customer will not be deemed to have entered the Contest.

    Entries received which are not submitted via the official entry method will not be accepted. Use of script, macro or any automated system to enter the Contest is prohibited and entries made (or which appear to have been made) using any such system may be treated as void. Any illegible, incomplete or fraudulent entries will be rejected. Participants should be aware that they may be subject to data charges depending on their own individual arrangements for Internet access. All entries are subject to verification at any time and for any reason.

  4. WINNERS AND PRIZES: The Prize available to be won is as follows: 2 Club Seat Canucks vs. Boston Bruins Hockey Tickets (for December 14th, 2024) and a Keg Steakhouse Gift Card ($250) (approximate total retail value: $1,500).

    All winners assume any and all liability for any injury or damage caused, or claimed to be caused, by entering, participating in this Contest or the use or redemption of a Prize. Prizes are as stated and are non-exchangeable and non-transferable. There is no cash or other alternative to the prize in whole or in part.

    In the event that, for reasons beyond the Sponsor’s reasonable control the Sponsor is unable to award the prize as described in these rules, the Sponsor reserves the right to award a prize of a similar nature and an equivalent value, or at its sole discretion, the cash value of the prize. The Sponsor also reserves the right to award a prize of a similar nature and an equivalent value, or at its sole discretion, the cash value of the prize if in its reasonable discretion it is appropriate to do so.

  5. ODDS OF WINNING: The odds of winning will depend on the number of eligible entries received by the Sponsor during the Contest Period, and would be calculated by taking the number of Prizes available and dividing it by such number of eligible entries.

  6. SKILL TESTING QUESTION: The potential winner will be required, as a condition of winning a Prize, to correctly answer, without assistance of any kind, the Sponsor’s time-limited, mathematical skill-testing question to be administered via email to the potential winner.

  7. WINNER SELECTION AND CONFIRMATION: Potential winners will be notified by email or using other contact details provided to the Sponsor within 6 days of the end of the Contest Period. All reasonable endeavours will be made to contact the winner three times after being selected. If a potential winner cannot be contacted or is not available, the Sponsor reserves the right to re-draw another potential winner from the valid entries that were received during the Contest Period (but is under no obligation to select any alternative potential winners). The Sponsor is not responsible for the failure for any reason whatsoever of a potential winner to receive notification or for the Sponsor to receive a potential winner’s response.

    The winner will be required to pick up the Prize from a location designated by the Sponsor. Winners may be required to submit valid identification before receiving their Prize.

    BEFORE BEING DECLARED THE CONFIRMED PRIZE WINNER, the potential winner will also be required to:

    1. sign the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these rules; (ii) acknowledges acceptance of the Prize as awarded; (iii) releases the Sponsor and each of their respective officers, directors, employees, agents, representatives, contractors, successors and assigns (collectively, the “Released Parties”) from any and all liability, claims or action of any kind whatsoever for injuries (including death), damages or losses to persons (including the entrant) and property that may be sustained, in whole or in part, directly or indirectly, in connection with this Contest or in connection with the submission of the entry, his/her participation therein and/or the awarding of the Prize; and (iv) indemnifies the Released Parties against any loss, damage or expense, including legal fees, that any of the Released Parties may suffer or incur as a result of any non-compliance by entrants with any of the Contest rules or participation in the Contest and/or in connection with the acceptance and/or exercise by an entrant of a prize, and the use of entries by the Sponsor; and

    2. correctly answer the skill testing question.

    If the potential winner: (i) fails to return the properly executed Contest documents within the specified time; (ii) cannot accept (or is unwilling to accept) the Prize as awarded for any reason; (iii) is determined to be in violation of these rules (all as determined by the Sponsor in its sole and absolute discretion); and/or (iv) fails to correctly answer the skill testing question then they may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion to select another potential winner (in which case the foregoing provisions of this section shall apply to such newly selected potential winner).

  8. ACKNOWLEDGEMENT: The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of entries and/or entrants. By participating in this Contest, entrants agree to be legally bound by the terms and conditions of these rules. ANYONE DETERMINED TO BE IN VIOLATION OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME.

    The Sponsor reserves the right, in its sole and absolute discretion, to withdraw, amend or suspend or cancel this Contest (or to amend these rules) without prior notice or obligation in any way and for any reason or without reason, including but not limited to in the event of:

    • tampering, error, technical problem, computer virus, bugs, unauthorized intervention, fraud, receipt of no eligible entries or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest and any attempt to undermine the legitimate operation of this Contest in any way, as determined by Sponsor in its sole and absolute discretion, is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law;

    • any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever; or

    • circumstances which render the Contest impossible, illegal, unconscionable, impractical to administer; or commercially unreasonable to operate in accordance with these rules.

    For greater clarity cancelling or suspending the Contest does not constitute the completion of the Contest Period.

    The Released Parties will not be liable for: (i) any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (ii) the failure of any entry to be received, captured or recorded for any reason, including, but not limited to, technical problems or traffic congestion on the internet or at any website; (iii) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; and/or (iv) any combination of the above. In the event of a dispute regarding who submitted an online entry, entries will be deemed to have been submitted by the authorized account holder of the e-mail account submitted at the time of entry. “Authorized account holder” is defined as the person who is assigned an email address by an internet provider, online service provider, or other organization (e.g. business, educational institute, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. An online entrant may be required to provide proof (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification) that he/she is the authorized account holder of the e-mail account associated with the entry in question.

  9. OTHER CONDITIONS: Sponsor reserves the right, in its sole and absolute discretion, and without prior notice to adjust any of the dates and/or timeframes stipulated in these rules, to the extent necessary, for purposes of verifying compliance by any entrant or entry with these rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these rules, or for any other reason. In the event of any discrepancy or inconsistency between the terms and conditions of these rules and disclosures or other statements contained in any Contest-related materials; the terms and conditions of these rules shall prevail, govern and control to the fullest extent permitted by law.

  10. PUBLICITY AND ENTRANT INFORMATION: By entering this Contest, each entrant expressly authorizes the Sponsor and its agents and/or representatives, to store, share and use the personal information submitted with his/her Contest entry for the purpose of administering the Contest or any publicity carried out by the Sponsor, without further notice or compensation. The Sponsor’s Privacy Policy is available at https://neighbourhoodliquor.com/privacy-policy.

  11. LAW: The Contest is void where prohibited by law and is subject to all applicable Canadian federal, provincial, territorial, municipal and local laws. To the fullest extent permitted by applicable law, all issues and questions concerning the construction, validity, interpretation and enforceability of these rules or the rights and obligations of entrants or Sponsor in connection with the promotion will be governed by and construed in accordance with the domestic laws of the Province of British Columbia and the federal laws of Canada applicable therein, without giving effect to any choice of law or conflict of law principles that would cause the application of any other jurisdiction’s laws.

    Each entrant hereby consents to the exclusive jurisdiction and venue of the courts located in British Columbia in any action to enforce (or otherwise relating to) these rules or relating to this promotion, unless this would not be allowed by applicable law.

  12. INTELLECTUAL PROPERTY: All intellectual property, including but not limited to trademarks, logos, designs, promotional materials, web pages, source codes, images, drawings, illustrations, slogans and representations are owned by the Sponsor. All rights reserved. Unauthorized copying or use of any of the Sponsor’s intellectual property without the express written consent of the Sponsor is strictly prohibited.
